HB 29 – Unfair and Deceptive Pricing Amendments

Official bill purpose:

This bill modifies provisions relating to unfair and deceptive pricing.

This bill:

  • Defines terms;
  • Prohibits hidden fees by requiring the clear and conspicuous disclosure of the total price in an offer or an advertisement for a product;
  • Directs the Division of Consumer Protection to administer and enforce the chapter; and
  • Grants the Division of Consumer Protection the power to impose a fine and seek court relief.

HB 29 passed out from the Business and Labor Interim Committee.
The bill forms a new Division of Consumer Protection. Among the bills proposed to be controlled by the Division of Consumer Protection are:
  • Utah Consumer Sales Practices Act;
  • Credit Services Organizations Act;
  • Telephone and Facsimile Solicitation Act;
  • Telephone Fraud Prevention Act;
  • Uniform Debt-Management Services Act;
  • Utah Consumer Privacy Act;
  • Utah Commercial Email Act: and Unfair and Deceptive Pricing Act.

All or part of these Acts could involve credit union operations.  We do not want or need regulation from another agency.

“Product” is defined as a …service…that is the subject of a consumer transaction.  This definition may include the financial services provided by a credit union.  We should at least seek an exemption from this bill.
