This bill allows a constable to establish a payment schedule with an individual instead of seizing the individual’s property:

  • Allows a constable to establish a payment schedule with an individual instead of seizing the individual’s property; and
  • Makes technical and conforming changes.

Association notes/why we’re tracking this:

SB 156 Constable Amendments allows a constable to establish a payment arrangement as an alternative to seizing property.  This is an alternative that credit unions should support.  The practicality of seizing property makes it a difficult remedy to rely on.
Some questions remain with the bill, which we’re working to get answers to.
