Stop payment requests can present complex operational and legal challenges for credit unions. This session will provide a clear, practical overview of the rules governing stop payments across different types of transactions and payment channels.
We’ll begin with a discussion of stop payment rights under the Uniform Commercial Code (UCC), including how members can request stop payments on checks they have written, applicable timeframes, and the legal effect of those requests. We’ll then contrast those rules with stop payments involving credit union-issued instruments, such as teller’s checks and cashier’s checks, where the ability to stop payment is far more limited and subject to different legal standards.
The session will also cover stop payment protections for electronic funds transfers under Regulation E, including timing requirements and member rights when attempting to stop preauthorized or recurring payments.
